That&#8217;s understandable, because the tax side is the whole reason to bother. No profit tax, no VAT on qualifying work, a ceiling on the social contributions you pay for your people, and a lower income-tax rate for them too. So companies pour effort into <a href=\"https:\/\/recruitment.by\/eng\/pages\/services\/joining-htp\/\">winning residency<\/a>, and the day the confirmation arrives, they mentally cross it off the list.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That&#8217;s the mistake. Residency isn&#8217;t something you win once; it&#8217;s something you keep, and the companies that lose it mostly don&#8217;t do anything scandalous to get there. A form goes in late. The business shifts into slightly different work. Then an audit turns up the gap. On paper the benefits run <a href=\"https:\/\/en.wikipedia.org\/wiki\/Belarus_High_Technologies_Park\">until 2049<\/a>, but only for as long as you keep your side of the bargain.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The price of slipping isn&#8217;t just the perks stopping, either. If your status gets pulled, the tax you didn&#8217;t pay can come back at the ordinary rates, so a missed form quietly becomes a bill. Which is why it&#8217;s worth being clear-eyed about what staying in actually involves: what you file, when the audit happens, and the short list of things that get companies struck off.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What you&#8217;re actually signing up for<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">It helps to picture HTP status as something you sign rather than something you&#8217;re awarded. Joining means agreeing to a set of conditions with the park&#8217;s administration. You keep your work inside a defined list of IT activities. You let the administration and its supervisory board keep an eye on you. And you report in at fixed points through the year. The framework goes back to the 2005 decree that set the park up and the later digital-economy decree that broadened it, and <a href=\"https:\/\/economy.gov.by\/en\/pvt-en\/\">the state spells out who qualifies and how you register<\/a> in some detail.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One thing throws foreign owners early on: the park isn&#8217;t a place you move into. It&#8217;s a country-wide regime, so a qualifying company gets the treatment from wherever its office already is. Handy, but it doesn&#8217;t buy you any slack on the rules.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The bigger surprise is the tax system. HTP status doesn&#8217;t layer on top of the simplified regime; residents sit on the general system, and that isn&#8217;t negotiable. If your Belarusian company was on the simplified system, joining means moving across from month one and picking up the general-system filings that come with it. Getting the company <a href=\"https:\/\/recruitment.by\/eng\/pages\/htp-residency\/\">set up as a resident<\/a> cleanly at the start spares you a lot of unpicking later. The upside is genuinely good. On their own they&#8217;re trivial. The problem is that they&#8217;re easy to forget right up until someone official asks where the paperwork is.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Each quarter you tell the administration and the tax office how money moved through your accounts, electronic money included. That one is due by the 10th of the month after the quarter ends, on <a href=\"https:\/\/spex.by\/eng\/news\/reports-high-tech-park-residents\">a form the administration provides<\/a>, so at least you&#8217;re not guessing at the format. A dead-quiet quarter doesn&#8217;t get you out of it, either. No activity still means a filing, and if you drop out of the regime mid-year you file for the months you were in it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The contribution is the part you feel in the books. Residents hand 1% of the last quarter&#8217;s revenue from permitted activities to the park&#8217;s administration, due by the 20th of the month after the quarter. It comes off revenue, not payroll, so it isn&#8217;t a staffing cost, and since paying it is a legal condition of the status, you get to book it as a deductible expense rather than just eating it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Alongside the quarterly stuff there&#8217;s a yearly activity report, separate books kept just for your permitted work, and the usual general-system returns. Don&#8217;t wave off that separate accounting. It&#8217;s what lets an auditor later draw a clean line around the revenue that actually qualifies, and it&#8217;s miserable to piece together after the fact. If none of this is how you want your own people spending their time, it&#8217;s the sort of load <a href=\"https:\/\/recruitment.by\/eng\/pages\/services\/hr-consulting\/\">accounting and back-office support<\/a> is built to take.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Here&#8217;s the whole thing on one calendar:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><tbody><tr><td>Quarterly report on account and e-money flow<\/td><td>By the 10th of the month after the quarter<\/td><\/tr><tr><td>1% revenue contribution to the HTP administration<\/td><td>By the 20th of the month after the quarter<\/td><\/tr><tr><td>Annual financial-statement audit completed<\/td><td>By 30 June of the following year<\/td><\/tr><tr><td>Auditor&#8217;s opinion filed with the HTP administration<\/td><td>By 1 July of the following year<\/td><\/tr><tr><td>Annual activity report<\/td><td>On the administration&#8217;s schedule<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Deadlines follow the current HTP regulations; confirm the exact filing form with the administration each year.<\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The annual audit<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Once a year it all gets looked at properly. Every resident has to have its yearly financial statements audited, wrapped up by 30 June the year after. The auditor&#8217;s opinion goes to the administration by 1 July, and, as a separate step, you flag that the audit happened to the Ministry of Finance through <a href=\"https:\/\/www.minfin.gov.by\/\">an online form on its site<\/a>. Two dates, two places, and tripping on either turns something you actually did into a problem.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The part people don&#8217;t expect is how far the auditor&#8217;s eye travels. It isn&#8217;t only whether the numbers reconcile. They give a standalone verdict on whether you worked out and paid that 1% correctly, and they read through your internal orders, source documents, controls and paper trail to check that what the company really does still lines up with the terms of your residency. That&#8217;s where sloppy reporting and quiet scope-drift come to light. There&#8217;s a bright side, mind you. A clean audit isn&#8217;t just something the administration wants to see; it&#8217;s what tells a bank or an investor the numbers are real. And if your payroll and filings already run through a <a href=\"https:\/\/recruitment.by\/eng\/pages\/peo-services\/\">managed payroll or PEO setup<\/a>, a lot of what the audit pokes at is already sitting in order.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What can actually get you excluded<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is the bit people ask about first. Losing HTP status hardly ever comes out of nowhere. It nearly always traces back to one of a few things, and most of them creep up rather than arrive in a single blow.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The commonest is wandering outside your permitted activities. The park is precise about which IT work counts, and the business you actually do has to stay inside those lines. Growing companies are the ones this bites. You add a service, or sign a client whose work sits at a slightly different angle, and suddenly there&#8217;s revenue on the books that doesn&#8217;t belong to the regime. Nobody decided to break a rule; the business moved and the paperwork stayed put.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Next is getting the contribution wrong, whether that&#8217;s paying late or running the 1% off the wrong figure. It sounds like the sort of slip anyone would forgive. It isn&#8217;t, because paying it properly is written into the conditions of being a resident.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">From there the list runs about how you&#8217;d guess. Reports that never get filed. An audit skipped, or one that comes back with an opinion you can&#8217;t stand behind. Information handed to the administration that later proves false. And beneath all of it, if you simply stop meeting the grounds you got in on, the activity criteria or the registered project, the status can go however neat your filings were.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This last part is why the boring quarterly dates are worth caring about. Being excluded doesn&#8217;t just switch off the benefits from that day. The tax you were spared can be recalculated at the standard rates, profit tax and VAT back up at 20%, so one compliance slip reaches back and lands as a bill for a stretch you had long since filed away. That backward reach is the real sting.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The bits that catch foreign owners off guard<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A handful of things about the regime aren&#8217;t obvious from outside Belarus, and all of them are cheaper to learn now than in the middle of an audit. HTP status doesn&#8217;t override labour law: your Belarusian staff are hired, managed and let go under the ordinary Labour Code, notice periods and procedures and all. It doesn&#8217;t waive licences either, so anything that needs one outside the park needs one inside it. You keep separate books for the permitted work rather than throwing everything in together. And it&#8217;s a regime for companies, so a sole trader can&#8217;t be a resident, <a href=\"https:\/\/ambylegal.by\/services\/information-technologies-lawyer-in-belarus\/htp\/\">as the legal groundwork makes plain<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">None of that is a dealbreaker, and plenty of the surrounding rules actually help. Residents get easier currency handling and can sign with foreign counterparties electronically, for two. The point is only that the perks arrive with obligations attached, and it&#8217;s worth seeing both before you sign. The catch is that it never lets up, and a busy team will always have something more pressing than a quarterly form. The companies that hold onto the status without much drama tend to do three fairly dull things.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mostly it&#8217;s one person making the deadlines their job. Someone owns the 10th, the 20th and the 30th of June, and they&#8217;re on a calendar rather than in somebody&#8217;s head. The accountant and the auditor get lined up in spring, not on the 28th of June. And as the company grows, someone stays curious about where the money is actually coming from, because a good new contract can quietly be the thing that pushes you off the permitted list, and you&#8217;d rather notice that yourself than hear it from an auditor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There&#8217;s a shortcut too, if compliance isn&#8217;t where you want your head. Employ your Belarus team through a company that is already an HTP resident, and the reporting, the contribution and the audit become its standing job rather than a machine you have to build and mind. What the company actually does has to stay inside the park&#8217;s list of IT activities. Put your Belarus team on the books of a company that is already a resident, and you get the people and the tax treatment while the reporting, contribution and audit stay with them.
